Frequently Asked Questions
How long do I have to file a claim after a wreck in Tennessee?
In most cases, just one year from the date of the crash. That is one of the shortest deadlines in the country, and if you miss it, your claim is almost always gone for good. There are a few narrow exceptions, but you should never count on them. The sooner you call, the more time we have to build your case.
How much does it cost to hire Labrum Law Firm?
Nothing upfront. We work on a contingency fee, which means our fee is a percentage of what we recover for you. If we do not win, you do not pay us a fee. Your case review is free, and every term is explained in writing before you sign anything.
What should I do right after a car accident?
Get to safety and call 911. Get medical care even if you feel fine, because adrenaline can hide injuries for days. Take photos of the vehicles, the scene, and your injuries, and get names and numbers from witnesses. Then call us before you talk to the other driver’s insurance company.
Should I talk to the other driver’s insurance company?
Be careful. The adjuster’s job is to pay you as little as possible, and a recorded statement can be used against you later. You can tell them your lawyer will be in touch. Once you hire us, we handle the calls, the forms, and the back and forth.
What if the wreck was partly my fault?
You may still have a case. Tennessee follows a modified comparative fault rule. If you are less than 50% at fault, you can still recover money, reduced by your share of the blame. Insurance companies often try to push more of the blame onto you so they can pay less, which is one more reason to have a lawyer in your corner.
How much is my case worth?
It depends on how badly you were hurt, your medical bills, the income you lost, how the injury changes your daily life, and how much insurance coverage is available. Any lawyer who promises a number on day one is guessing. After a free review, we can tell you what we see and what comes next.
What if the driver who hit me has no insurance?
You may still have options. Your own policy may include uninsured or underinsured motorist coverage that pays when the at-fault driver cannot. We review every policy that could apply, including ones you may not know you have.
Who pays my medical bills while my case is pending?
Usually your health insurance or the medical payments coverage on your own auto policy pays first. The at-fault driver’s insurer typically pays once, at the end, as part of your settlement or verdict. We help you sort out who pays what so the bills do not pile up while you heal.
Will I have to go to court?
Probably not. Most injury claims settle without a trial. But insurers tend to make better offers when they know a lawsuit is a real possibility, and we are ready to file when that is what it takes.
What if I was hit by a commercial truck or an Uber or Lyft driver?
These cases are more complex. A trucking company, a rideshare company, or more than one insurance policy may be on the hook, and key evidence like driver logs, dash cam video, and app data can disappear fast. Call as early as you can so we can move to preserve it.
